Terms of Service

1. Acceptance of terms

By downloading, installing, or using the ThinkGrid application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legal agreement between you and the company that supplied the App to you: TGIV Holding BV, trading as De Appmakers, registered in the Netherlands under Chamber of Commerce number 87876418, if you obtained the App from the Apple App Store; or De Appmakers BV, registered in the Netherlands under Chamber of Commerce number 93651783, if you obtained the App from Google Play. That company is referred to in these Terms as "we", "us", or "our", and is the developer and publisher of ThinkGrid.

2. Description of the app

ThinkGrid is a mobile application available on iOS and Android. We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We are not liable to you or any third party for any such changes.

3. Eligibility

You must be at least 4 years old to use ThinkGrid. By using the App, you represent and warrant that you meet this requirement. If you are under 13 years of age, your parent or legal guardian must agree to these Terms on your behalf.

4. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, on any Apple-branded device you own or control if you obtained the App from the Apple App Store, or on any Android device you own or control if you obtained the App from Google Play. This license is subject to these Terms and to the terms of service of the store from which you obtained the App (the Apple App Store Terms of Service or the Google Play Terms of Service, as applicable).

You may not:

• Copy, modify, or distribute the App or its content;
• Reverse engineer, decompile, or disassemble the App;
• Rent, lease, loan, sell, or sublicense the App;
• Use the App for any unlawful purpose.

5. Purchases and subscriptions

ThinkGrid offers optional in-app purchases. Purchases made on iOS are processed by Apple through the App Store; purchases made on Android are processed by Google through Google Play. Each is subject to that store's payment terms.

ThinkGrid Plus is available as an auto-renewing yearly subscription, which begins with a 7-day free trial, and as a one-time Lifetime purchase. Optional tips are one-time purchases.

For the yearly subscription: payment is charged to your store account when the free trial ends. The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your App Store or Google Play account settings; uninstalling the App does not cancel it.

Prices are shown in the App before purchase and may change. We will not change the price of an existing subscription without notice and, where required, your consent.

Refunds are handled by the store you purchased from. Requests for purchases made on iOS go to Apple; requests for purchases made on Android go to Google. Consumers in the EU may also have a statutory right of withdrawal.

6. Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

7. Intellectual property

All content, design, graphics, software, and other materials in the App are owned by or licensed to us and are protected by applicable intellectual property laws. The ThinkGrid name and logo are our trademarks. You may not use them without our prior written consent.

8. Disclaimer of warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.

9. Limitation of liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, even if we have been advised of the possibility of such damages. Our total liability to you for any claims shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or €10, whichever is greater.

10. Third-party services

The App may contain links to or integrations with third-party services. We are not responsible for the content, privacy practices, or terms of any third-party services. Your use of such services is at your own risk and subject to their respective terms.

11. Apple requirements

This section applies to copies of the App obtained from the Apple App Store.

These Terms are between you and TGIV Holding BV only, not with Apple Inc. Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App.

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple has the right to enforce these Terms against you as a third-party beneficiary.

12. Governing law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts of the Netherlands. If you are a consumer resident in the European Union, this does not deprive you of the protection of mandatory consumer law in your country of residence, and you may also bring proceedings in the courts of that country.

13. Changes to these terms

We may update these Terms from time to time. We will notify you of any significant changes by updating the "Last updated" date at the top of this page or through a notification in the App. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.

14. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease.
